DubaiSA Atlantic Realty LLC - Property Owner Agreement

Important Notice: Dubaisa Atlantic Realty LLC acts solely as a representative and booking agent for property owners ("Hosts") and is not the owner of any rental properties. All rental agreements are between the guest and the property owner, with Dubaisa Atlantic Realty LLC serving as the intermediary booking and management agent.

1. Agreement and Relationship

This Host/Vendor Agreement ("Agreement") is made by and between Dubaisa Atlantic Realty LLC ("Agent", "we", "us", or "our") and the property owner ("Host", "you", or "your") as of the date of electronic acceptance. This Agreement sets forth the terms and conditions under which the Agent will represent the Host in marketing, booking, and managing vacation rental properties.

The Agent acts solely as an intermediary booking agent and property manager. We are not a party to the rental agreement between the Host and guest, nor are we a real estate broker or insurer. Our role is limited to facilitating bookings and providing property management services as specified herein.

2. Host Registration and Verification

To become a Host, you must:

  • Be at least 18 years of age and have the legal right to enter into binding contracts
  • Own the property or have explicit written permission from the property owner to manage and rent the property
  • Provide accurate personal and property information during registration
  • Verify your identity and property ownership through documentation we reasonably request
  • Maintain valid liability insurance coverage for your property
  • Comply with all applicable local laws, regulations, and zoning requirements for short-term rentals

We reserve the right to suspend or terminate your account if we determine that you have provided false information or do not meet our hosting standards.

3. Property Listings and Accuracy

Hosts are responsible for creating and maintaining accurate, complete, and up-to-date property listings. This includes:

  • Providing detailed and accurate descriptions of the property, including size, amenities, features, and sleeping arrangements
  • Uploading high-quality, current photographs that fairly represent the property
  • Clearly disclosing any restrictions, limitations, or potential inconveniences
  • Promptly updating availability calendars and pricing
  • Notifying us immediately of any changes to the property or amenities

We reserve the right to edit, suspend, or remove listings that contain inaccurate information, violate our policies, or fail to meet our quality standards. Hosts are solely responsible for ensuring their listings comply with all applicable laws and regulations.

4. Pricing and Commission Structure

The Host sets the nightly rate for their property, and we charge a commission on each completed booking. Our standard commission rate is [XX]% of the total booking amount.

Hosts are responsible for setting competitive and reasonable prices for their properties. We may provide pricing recommendations, but the final pricing decision rests with the Host. All prices must include any mandatory taxes or fees unless otherwise specified.

We reserve the right to offer promotional discounts at our discretion. Any discount amounts will be deducted from the total booking value before commission calculation.

5. Payouts to Hosts

Payouts to Hosts will be processed according to the following schedule:

  • Initial deposit payout: Within 3 business days after guest check-in
  • Final balance payout: Within 5 business days after guest check-out

Hosts can set up multiple payout methods and create routing rules to distribute earnings:cite[2]:

If you work with a co-host, you can set up co-host payouts to share a percentage or fixed amount of your earnings. When both routing rules and co-host payouts apply to the same listing, routing rules are processed first, then co-host percentages apply to each portion:cite[2].

All payouts are subject to review and may be delayed or withheld in cases of disputed bookings, suspected fraud, or violation of this Agreement.

6. Cancellations and Refunds

Host-Initiated Cancellations:

If a Host cancels a confirmed reservation:

  • The Host will not receive any payment for the cancelled booking
  • We may charge a cancellation fee of [XX]% of the booking value
  • Your property may be temporarily de-ranked in search results
  • Repeated cancellations may result in account suspension or termination

Guest-Initiated Cancellations:

Guests may cancel according to the cancellation policy selected for your property. We offer the following standard cancellation policies:

  • Flexible: Full refund if canceled at least 24 hours before check-in
  • Moderate: Full refund if canceled at least 5 days before check-in
  • Strict: 50% refund if canceled at least 14 days before check-in

Refund Processing:

When a refund is issued to a guest:

  • The refund amount will be deducted from your future payouts
  • Our commission on the refunded amount will also be refunded to the Host
  • Refunds may take 5-10 business days to process depending on the payment method

7. Chargebacks and Payment Disputes

Chargebacks occur when a customer disputes a transaction with their bank or credit card company, resulting in a reversal of funds:cite[1]. Chargebacks are particularly costly for merchants, with fees typically between $30-$50 per chargeback in addition to the lost revenue:cite[9].

Chargeback Process:

When a chargeback occurs:

  • We will notify you immediately and provide details of the dispute
  • You must provide all requested evidence within 5 business days
  • Evidence may include: booking confirmation, proof of service delivery, communication with guest, property access records, and photos
  • We will submit the evidence to the payment processor to contest the chargeback
  • If the chargeback is upheld, the amount will be deducted from your account

Chargeback Insurance:

We strongly recommend that Hosts obtain chargeback insurance to protect against financial losses from fraudulent chargebacks:cite[1]. Chargeback insurance typically covers:

  • Reimbursement of chargeback fees
  • Reimbursement of disputed transaction amounts
  • Assistance with dispute resolution
  • Access to fraud detection tools

Note that chargeback insurance usually does not cover operational costs, fraudulent transactions not resulting in chargebacks, loss of merchandise, or damage to business reputation:cite[1].

Preventing Chargebacks:

To minimize chargeback risk:

  • Maintain clear and accurate property descriptions
  • Provide excellent customer service and respond promptly to inquiries
  • Document all guest communication and agreements
  • Keep detailed records of property condition before and after stays
  • Use clear billing descriptors that guests will recognize

8. Host Responsibilities and Liabilities

As a Host, you are responsible for:

Property Maintenance and Cleanliness:

  • Ensuring the property is safe, clean, and in good repair before each guest arrival
  • Maintaining all appliances, systems, and amenities in working order
  • Providing essential supplies including linens, towels, and basic toiletries
  • Ensuring the property meets all health and safety standards

Legal Compliance:

  • Obtaining all required permits, licenses, and registrations for short-term rentals
  • Complying with local zoning laws, HOA rules, and building regulations
  • Maintaining adequate insurance coverage (liability and property damage)
  • Remitting all applicable taxes unless handled by Agent

Guest Management:

  • Being available or providing a local contact for guest issues during their stay
  • Responding to guest inquiries and issues within 24 hours
  • Establishing and enforcing reasonable house rules
  • Respecting guest privacy and following proper procedures for property access

The Host, not Dubaisa Atlantic Realty LLC, is solely liable for any injuries, damages, or losses that occur on the rental property. Hosts agree to indemnify and hold harmless Dubaisa Atlantic Realty LLC from any claims, liabilities, damages, or expenses arising from their property or hosting activities.

9. Insurance Requirements

All Hosts must maintain appropriate insurance coverage for their rental properties. At a minimum, this should include:

  • Liability Insurance: Coverage for guest injuries or accidents on your property
  • Property Damage Insurance: Coverage for damage to your property and belongings
  • Loss of Income Insurance: Coverage for rental income loss due to covered property damage

You must provide proof of insurance upon request and notify us immediately of any changes to your coverage. We recommend discussing your short-term rental activities with your insurance provider to ensure adequate coverage.

Dubaisa Atlantic Realty LLC maintains errors and omissions insurance for our booking services, but this does not extend to coverage for Host properties or liabilities.

10. Damage to Property

Hosts are responsible for reporting any guest damage within 24 hours of check-out. To process a damage claim:

  • Document the damage with photographs or video
  • Provide before-and-after evidence when possible
  • Submit repair estimates or replacement costs
  • Provide any relevant guest communication about the damage

We will review the claim and attempt to collect from the guest. If successful, funds will be forwarded to the Host minus any processing fees. If unsuccessful, the Host may pursue collection through other means or file an insurance claim.

Hosts acknowledge that Dubaisa Atlantic Realty LLC is not liable for any damage to Host property and acts only as an intermediary in damage dispute resolution.

11. Termination of Agreement

This Agreement may be terminated by either party with 30 days written notice. However, the Agreement remains in effect for all confirmed bookings that extend beyond the termination date.

We may terminate this Agreement immediately if:

  • You violate any term of this Agreement
  • You provide false or misleading information
  • Your actions damage our reputation or business relationships
  • You fail to maintain required insurance or legal compliance
  • You engage in fraudulent or illegal activities

Upon termination, all outstanding payments will be settled according to the normal payout schedule, and your property listings will be removed from our platform.

12. Limitation of Liability

To the fullest extent permitted by law, Dubaisa Atlantic Realty LLC's total liability to Hosts under this Agreement shall be limited to the total commissions paid by the Host to Dubaisa Atlantic Realty LLC in the six months preceding the event giving rise to the claim.

Dubaisa Atlantic Realty LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data, arising from or related to this Agreement.

13. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Dominican Republic. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of the Dominican Republic.

Prior to initiating formal proceedings, both parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes shall be resolved through mediation before pursuing litigation.
